ACLU Colorado Threatens Sheriffs with Lawsuits Over Cooperation with ICE and Trump's Immigration Policies

The American Civil Liberties Union (ACLU) of Colorado has issued a stern warning to sheriffs across the state, threatening legal action against any cooperation with Immigration and Customs Enforcement (ICE) or compliance with President-elect Trump's anticipated mass deportation plans. In a letter penned by Executive Director Deborah Richardson and Legal Director Tim MacDonald, the ACLU cautioned that sheriffs who participate in ICE raids or detain individuals solely at ICE's request could face personal liability, including financial penalties of up to $25,000.

The organization drew parallels between Trump's proposed deportation initiatives and the Japanese internment camps of World War II, emphasizing the potential legal repercussions for law enforcement officials involved. The ACLU underscored that any officer violating rights protected under the Colorado Constitution could be held liable for damages and legal fees, with sheriffs potentially responsible for covering uncollectible judgments.

The ACLU also criticized the Aurora Police Department's recent collaboration with ICE in detaining individuals suspected of involvement in a violent home invasion and kidnapping incident linked to the Venezuelan gang Tren de Aragua (TdA). The incident involved a Venezuelan immigrant couple who were reportedly assaulted, robbed, and kidnapped from their apartment in the Denver suburbs. The ACLU argued that the police department overstepped its legal authority during the operation, causing harm and distress to a vulnerable community.

Castle Pines City Council member Roger Hudson expressed his disappointment with the ACLU's stance, arguing that the organization was prioritizing the rights of non-citizens, including those residing in the country illegally, over the rights of taxpayers. He criticized liberal policies on immigration and other issues, expressing hope for change with the upcoming inauguration of President Donald Trump.
